1. Definitions
In these Terms and Conditions, the following terms carry the meanings set out below:
- "Verdanta" / "we" / "us" / "our": Verdanta senior care residence, 153 Rama II Road, Soi 50, Bang Khun Thian, Bangkok 10150, Thailand
- "Service": Any of the care programmes or consultative services offered by Verdanta, including Comprehensive Residential Care, Palliative Comfort Program, and Family Transition Support
- "User" / "you": Any individual who accesses this website or enters into an agreement with Verdanta
- "Resident": An individual who resides at Verdanta under a care agreement
- "Agreement": The service agreement entered into between Verdanta and the family or authorised representative of a resident
- "Content": All text, images, data, and materials appearing on this website
2. Acceptance of Terms
By using this website or engaging with Verdanta's services, you agree to be bound by these Terms and Conditions. If you are acting on behalf of another person, you confirm that you have the authority to enter into this agreement on their behalf.
Our services are intended for adults aged 18 years and over. Enquiries on behalf of prospective residents should be made by a family member, legal guardian, or authorised representative of legal age.
3. Service Description
Verdanta provides senior residential care services at its Bangkok facility, including accommodation, nursing care, nutritional support, and personalised activity programming. Full details of each service are available on the Solutions page.
Services are subject to availability. Verdanta reserves the right to decline a care request where the prospective resident's needs fall outside the scope of what can be safely and appropriately delivered at the facility. Where this applies, we will communicate this clearly and assist families in identifying alternative options where possible.
Geographic scope
Verdanta's residential care services are provided at our Bangkok facility only. The website may be accessed from other countries, but no representation is made that its content is applicable or lawful in jurisdictions outside Thailand.
4. User Accounts
Verdanta does not currently operate user accounts on its public website. Families receiving active care services may receive access to a secure family communication portal; terms governing that access are provided separately at the time of enrolment.
5. User Responsibilities
When using this website or entering into a service agreement with Verdanta, you agree to:
- Provide accurate, complete, and current information as requested
- Notify Verdanta promptly of any changes to relevant personal or medical information affecting a resident's care
- Communicate respectfully with all staff, residents, and other families
- Comply with the facility's visiting guidelines and health and safety protocols
- Refrain from using this website to transmit harmful, offensive, or misleading content
- Not attempt to access systems or data beyond what is required for your own use of the service
Prohibited activities
The following are expressly prohibited: interfering with the proper operation of this website; attempting to copy, reproduce, or distribute proprietary content without permission; using the website for commercial solicitation; and impersonating any person or organisation.
6. Intellectual Property
All content on the Verdanta website — including text, images, design elements, and the Verdanta name and logo — is owned by or licensed to Verdanta and protected under Thai and applicable international intellectual property laws. You may view, download, and print content for personal, non-commercial use only.
You may not reproduce, distribute, modify, or use any content from this website for commercial purposes without prior written consent from Verdanta. The Verdanta name and logo may not be used in any context without explicit written permission.
7. Service Fees and Payment
7.1 Pricing
Current service fees are listed on the Solutions page and quoted in Thai Baht (฿). Verdanta reserves the right to adjust pricing on reasonable advance written notice to current service users.
7.2 Payment terms
Monthly care fees are invoiced at the beginning of each month and are due within 7 days of invoice. Specific payment methods and detailed financial terms are agreed at the time of signing the service agreement. Late payment may result in a service review.
7.3 Refund policy
For monthly care services, fees are not refundable for periods already commenced. Where a resident departs mid-month for reasons beyond the family's control, a pro-rated adjustment may be considered at Verdanta's discretion. For the Family Transition Support service (a one-time advisory fee), the fee is non-refundable once initial consultations have commenced.
8. Service-Specific Terms
8.1 Comprehensive Residential Care
Care begins following the signing of a service agreement and the completion of an initial care assessment. Verdanta undertakes to provide the agreed care services to the standard outlined in the care plan. Care plans may be revised in response to changing needs, in consultation with the resident and family.
8.2 Palliative Comfort Program
This programme is provided in coordination with the resident's existing medical team. Verdanta provides a supportive care environment and does not act as a substitute for specialist medical intervention. The pace and character of care is reviewed regularly with family members and adjusted with sensitivity to changing needs.
8.3 Family Transition Support
This is a consultative service only. Participation does not constitute a commitment to place a loved one at Verdanta, and no obligation arises from using this service. It includes facility visits, care needs assessment, and advisory guidance.
9. Disclaimers
Verdanta's website and services are provided in good faith, with reasonable care and professional diligence. However, we do not warrant that the website is free from technical errors, that it will always be available without interruption, or that information on the website is always current.
Care outcomes in residential settings depend on a wide range of individual, medical, and social factors. Verdanta does not make any representations regarding specific health outcomes for any resident. All decisions regarding care remain subject to clinical assessment and professional judgement. Nothing on this website constitutes medical advice.
10. Limitation of Liability
To the fullest extent permitted by Thai law, Verdanta's aggregate liability for any claim arising out of or in connection with use of this website or our services shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim. Verdanta shall not be liable for indirect, consequential, special, or incidental losses.
Nothing in these Terms limits or excludes liability for gross negligence, wilful misconduct, fraud, or any matter which cannot lawfully be excluded or limited.
11. Indemnification
You agree to indemnify and hold harmless Verdanta and its staff from any claim, loss, or expense arising from your breach of these Terms, your misuse of this website, or any false or misleading information you have provided.
12. Termination
Either party may terminate a service agreement by providing one month's written notice. In circumstances where a resident's safety or the safety of others requires it, Verdanta reserves the right to terminate a service agreement with shorter notice and will communicate the reasons clearly. Verdanta will work cooperatively with families to arrange a smooth transition in all cases.
Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitation of liability — shall continue to apply following termination.
13. Dispute Resolution
If a concern arises regarding Verdanta's services, we encourage you to contact us directly in the first instance. We take feedback seriously and will make every effort to resolve concerns informally and promptly.
Where informal resolution is not achieved, disputes shall be governed by the laws of the Kingdom of Thailand and subject to the exclusive jurisdiction of the Thai courts.
14. General Provisions
These Terms constitute the entire agreement between the parties with respect to use of this website. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Verdanta's failure to enforce any right under these Terms shall not constitute a waiver of that right. These Terms may not be assigned by you without Verdanta's prior written consent.
15. Changes to These Terms
Verdanta may update these Terms and Conditions from time to time. Where changes are material, we will update the effective date at the top of this page and, where appropriate, notify families under active service agreements directly. Continued use of this website or services following the effective date constitutes acceptance of the revised terms.
